Native Stars Studios and Concierge Insurance Managers have filed a $35M lawsuit against Philip Westgren, Alex Lebovici, and Kung Fury 2 productions. The plaintiffs allege breach of contract, specific performance, conversion, and seek declaratory relief, claiming that after paying $12 million and waiting four years, the film "Kung Fury 2" remains incomplete and undelivered.

The lawsuit states that the film, with a budget of $35 million, has been plagued by significant production issues. According to the complaint, Creasun, a corporate film financier, initially advanced $12 million to KF2 Partners. The agreements stipulated that KF2 Partners would provide detailed monthly production accounting, deliver all film elements upon completion, and maintain transparency regarding expenditures.

A key allegation in the complaint highlights what the plaintiffs describe as egregious financial mismanagement. The KF2 Partners' refusal to provide proper accounting to secure subsequent payments led the plaintiffs to believe that exercising their contractual right to take over the movie was the only efficient way to complete the film.

The lawsuit further details that KF2 Partners failed to uphold their contractual obligations by:
● Providing only partial, untranslated German financial records with significant discrepancies, which a financial expert deemed "grossly inadequate."
● Failing to deliver essential film elements necessary for completion, such as raw footage, sound recordings, music tracks, visual effects files, editing project files, and all production documentation.
● Refusing to cooperate with the transition to new production management under Native Stars Studios and Concierge Insurance Managers, despite Creasun's "Takeover Right" established in a Binding Term Sheet.
Investor Minglu Ma, who has more than 20 years of extensive experience in the entertainment industry, believes she can effectively complete the movie by leveraging international assets and collaborating with Indigenous American tribes to bring the film to market.

The complaint also notes that Kung Fury 2 Europe UG is not registered with the California Secretary of State, in violation of state law.

Native Stars Studios and Concierge Insurance Managers are seeking a mandatory injunction compelling the immediate delivery of all film elements and production accounts with English translations, an order requiring cooperation with new production management, a judicial accounting of all funds, and compensatory damages. They also seek declarations regarding their right to complete and bond the film, as well as copyright ownership and distribution rights.

A jury trial has been demanded.
